Terms and Conditions of Jontish
- Introduction
These Terms and Conditions govern the legal relationship between Jontish (“the Company”) and the Client (“the Client”) for the provision of exterior cleaning services, including but not limited to window cleaning, soft washing, and pressure washing. By engaging our services, the Client agrees to be legally bound by these Terms. - Services Provided
2.1 Scope of Work: The Company will provide services as outlined in the service agreement or quote, which may include residential or commercial window cleaning (interior and/or exterior), soft washing (low-pressure chemical cleaning), and pressure washing (high-pressure cleaning of exterior surfaces).
2.2 Limitations: Jontish reserves the right to refuse or modify service in cases where work poses a safety risk, involves hazardous materials, or exceeds the scope of what was quoted.
2.3 Pre-Existing Conditions: The Client is responsible for informing Jontish of any fragile surfaces, deteriorating structures, recent paintwork, or sensitive installations. The Company is not liable for damage arising from undisclosed conditions or pre-existing defects. - Pricing and Payment Terms
3.1 Quotes and Estimates: All pricing is based on the size, scope, and condition of the area to be serviced. Quotes are valid for 14 days unless otherwise stated.
3.2 Payment Schedule: Unless otherwise agreed in writing, payment is due in full prior to or on the day of service. For ongoing contracts, payment terms are specified in the agreement.
3.3 Late Payments: A late fee of 5% per month may apply to overdue invoices. Continued non-payment may result in service suspension and legal recovery. - Cancellations and Access
4.1 Cancellations: Cancellations must be made with at least 24 hours’ notice. Failure to do so may incur a cancellation fee of up to 60% of the quoted service fee.
4.2 Access to Property: The Client must ensure safe and unobstructed access to all areas to be serviced. This includes access to gates, doors, electricity, water supply, and external taps where required.
4.3 Weather Conditions: Services may be rescheduled due to hazardous weather conditions (e.g., heavy rain, strong winds) that may compromise safety or quality of service. Clients will be notified promptly in such cases. - Damage and Liability Disclaimer
5.1 General Disclaimer: While Jontish takes every precaution to avoid damage, some surfaces (e.g., aged wood, oxidized paint, loose render) may be sensitive to pressure or chemicals and at risk of deterioration during service. The Client accepts this risk.
5.2 Glass and Windows: The Company is not responsible for pre-existing damage, scratches, poor-quality glass, or seal failures.
5.3 Liability Cap: Jontish’s total liability shall not exceed the total cost of the specific service provided. - Client Responsibilities
6.1 Preparation: The Client must clear the work area of vehicles, plants, furniture, fragile items, or any other obstacles before the team’s arrival.
6.2 Pets and Children: Clients must ensure pets and children are kept away from the service area during and after service.
6.3 Delays: If access is delayed or obstructed due to the Client’s failure to prepare the site, additional charges may apply. - Chemical Products and Safety
7.1 Use of Cleaning Agents: Jontish may use commercial-grade chemical agents that are effective for removing mould, grime, and organic matter. These products are not necessarily biodegradable or eco-friendly.
7.2 Surrounding Areas: The Client is responsible for advising Jontish of nearby sensitive materials, plants, or surfaces that may be affected by chemicals. Jontish is not liable for damage to landscaping, painted surfaces, or fixtures caused by chemical overspray or runoff unless due to negligence. - Non-Solicitation of Staff
8.1 Employment Protection: Clients shall not solicit, hire, or engage any Jontish employee directly during the term of service and for 12 months following termination. Breach of this clause may result in legal action and compensation. - Termination
9.1 Termination Conditions: Either party may terminate the agreement with written notice in cases of breach of contract, non-payment, or mutual agreement. All outstanding payments for completed work must be settled. - Indemnification
10.1 The Client agrees to indemnify and hold harmless Jontish and its personnel from any claims, damages, or losses arising from failure to disclose risks, failure to provide safe access, or misuse of the services. - Intellectual Property and Media Use
11.1 Jontish retains ownership of all branding, service descriptions, and photos or videos taken during the service, unless otherwise agreed in writing.
11.2 If the Client does not consent to photos of their property being used in promotional materials, they must inform Jontish in writing prior to service. - Governing Law
12.1 These Terms are governed by the laws of New South Wales, Australia. Any dispute shall be subject to the exclusive jurisdiction of the courts in NSW. - Updates to Terms
13.1 Jontish reserves the right to update or amend these Terms and Conditions. The latest version will always be available on the Company’s website or by request.
